How we collect, use and protect your personal information under the Data Protection (Jersey) Law 2018.

Heritage Planning Specialists Ltd is the data controller for the personal information described in this policy. This policy applies to this website and to our planning services.

What Type of Information We Collect

We currently collect and process the following types of information:

  • Personal identifiers, such as your name, postal address, email address and telephone number.
  • Property information relating to your project, including ownership details, photographs, drawings and survey or condition information.
  • Enquiry details you send us through our website contact form, by email, by telephone or in person.
  • Correspondence and records of our dealings with you, including notes of site visits and meetings.

We do not intentionally collect special category data (such as health information) and we do not knowingly collect information from children.

How We Get the Information and Why We Have It

Most of the personal information we process is provided directly by you for the following purposes:

  • To provide planning application services.
  • To contact you regarding your enquiry or project.

We may also receive personal information indirectly from contractors such as joiners, builders and estate agents, and from publicly available sources such as the Jersey planning register and property records, where this is needed to progress your project.

Under the Data Protection (Jersey) Law 2018, the lawful bases we rely on for processing this information are:

  • Your consent. You may withdraw your consent at any time by contacting us at info@heritageplanners.je.
  • Performance of a contract — we have a contractual obligation to you.
  • Legal obligation — we are required by law to process certain information.
  • Legitimate interests — to respond to enquiries, keep records of our work and manage our business, where doing so does not override your rights.

What We Do With the Information We Have

We use the information that you provide to:

  • Identify the property address and owner for planning services.
  • Arrange site visits.
  • Conduct property research.
  • Submit planning applications or condition reports on your behalf.
  • Respond to your enquiries and provide quotations.
  • Keep accounting and business records as required by law.

We do not sell your personal information, and we do not use it for automated decision-making or profiling. We do not send marketing emails unless you have asked us to.

Who We Share Your Information With

We may share your information with third parties where it is necessary to deliver our services or where we are required to do so by law, including:

  • The Government of Jersey Planning Department and other regulatory or public bodies, as part of a planning application or condition report.
  • Contractors working on your project, such as joiners, builders, architects and surveyors.
  • Our professional advisers, including accountants and legal advisers, where necessary.
  • Our IT, email, website and cloud hosting providers, who process information on our instructions.

Some of our service providers may store or process information outside Jersey. Where that happens, we take reasonable steps to ensure your information receives a level of protection consistent with the Data Protection (Jersey) Law 2018.

Website Enquiry Form and Cookies

When you submit our website enquiry form, the name, email address, telephone number (if provided) and message you enter are stored securely so that we can respond to you. Please do not include sensitive information in the form.

This website uses only the cookies and local storage necessary for the site to function and to keep it secure. We do not use advertising cookies. If we introduce analytics or other non-essential cookies in future, we will ask for your consent first and update this policy.

How We Store Your Information

Your information is securely stored on our company computers and systems, and with our cloud service providers, protected by appropriate technical and organisational security measures such as access controls, passwords and encryption in transit.

We retain your information for as long as it is needed to provide our services and to comply with legal or regulatory requirements. Project and accounting records are typically kept for up to ten years after our work concludes; general enquiries that do not proceed are normally deleted within two years. When information is no longer needed, we securely delete or destroy it by:

  • Permanently erasing electronic files.
  • Shredding physical documents.
  • Ensuring backups are appropriately deleted.

Data Breaches

We have procedures in place to detect, report and investigate personal data breaches. Where a breach is likely to result in a risk to your rights and freedoms, we will notify the Jersey Office of the Information Commissioner and, where required, inform you without undue delay.

Your Data Protection Rights

Under data protection law, you have the following rights:

  • Right of access: request copies of your personal information.
  • Right to rectification: request corrections or completion of inaccurate or incomplete information.
  • Right to erasure: request the deletion of your personal information in certain circumstances.
  • Right to restrict processing: request limitations on the use of your data in certain circumstances.
  • Right to object to processing: object to the processing of your data in certain circumstances.
  • Right to data portability: request that your information be transferred to another organisation or directly to you, in certain circumstances.
  • Right to withdraw consent: where we rely on your consent, you may withdraw it at any time.

You will not be charged for exercising these rights. We will respond to requests within one month, as required by the Data Protection (Jersey) Law 2018. Where a request is complex we may extend this by up to two further months and will tell you if we do. To make a request, please contact us at:
